Terms & Conditions Standard Booking
By making a booking with LondonUP! Ltd you are deemed to have read and accepted the following Terms and Conditions:

Please note that a Passport, National ID card and/or Driver's Licence must be given at time of check-in.
A Booking Confirmation can be used as a receipt to confirm the booking made with LondonUP! Ltd.
1. BOOKING & PAYMENT PROCEDURE
LondonUP! shall not be in breach of any clause of this agreement for failure to execute any of its obligations therein stipulated due to any event or occurrence outside of its reasonable control, including but not limited to fire, flood, extreme adverse weather conditions, terrorist act or natural disaster (casus fortuitous).
For every booking a good faith deposit, agency administration fee and check-out cleaning fee are payable before check-in. The security deposit is £300 (including a £50 key deposit). The agency fee depends on the number of guests in the booking and the cleaning fee depends on the type of property. These fees as of 01/02/2012 are:
Agency fee
- £50.00 for bookings with one guest
- £70.00 for bookings with two guests
- £75.00 for bookings with three guests
- £100.00 for bookings with four guests
- £125.00 for bookings with five guests
- £150.00 for bookings with six guests
Check-out cleaning fee:
- £20.00 for a room in a shared house/flat
- £25.00 for a studio flat
- £35.00 for a 1/2/3 bedroom apartment
All payments are due in advance of arrival. Credit card details will be held on file to cover any damages or other costs arising from client breach of terms. Bookings will be confirmed on receipt of payment. Upon receipt of the appropriate payment we will send you written confirmation of your booking by email. You may extend your stay after informing LondonUP! Ltd of your departure date if necessary, subject to availability. Payments may be made by cash (first payment in office, subsequent payments in bank branches), bank transfer, credit card ( a 1.5% fee is applied) and debit cards (£0.50 charge).
If you intend to pay by bank transfer payment should reach our account net of all bank charges. Please ask your bank to show your name and booking reference on the transfer. A screenshot of the transaction should also be e-mailed to us as proof of payment. All prices quoted are in UK Pounds Sterling and are correct at time of publication. Payment must be made to us in UK Sterling. On-line Bookings must be made by, or with the consent of, the cardholder. Clients must be at least 18 years old to make a booking with LondonUP! Ltd.
2. CANCELLATION POLICY
You may not transfer or resell your booking either in part or in full. If you do so, the booking will be considered cancelled and no deposit or other sums paid in advance will be refundable.
Cancellation of booking must be made in writing and submitted by email to contact.us@londonup.com If cancellation notice is received less than 2 weeks before the booking date the holding deposit is non-refundable.
No refunds will be made for non-arrivals.
The booking will be cancelled on the day that the written notice of cancellation is received by us.
Depending on the reasons for your cancellation, you may be able to reclaim cancellation charges from your insurance company if you have taken out travel insurance. We strongly recommend that clients purchase adequate travel insurance. Regrettably, for the reasons given above, we have to treat any curtailment of your stay as a cancellation.
For any cancellations the adminstration fee is non-refundable at any time.
3. AMENDMENTS TO BOOKINGS
If you wish to amend your booking (e.g. change the dates of your stay or the accommodation requested), we will use all our reasonable efforts to comply with your request, however you will be obliged to pay for any additional expenses that are incurred as a result. Please note that delaying your arrival date after the booking is made will not precipitate a delay in the date from which you must start paying rent for the accommodation booked. A fee of £15.00 is applicable to cover administration for change of rooms during your stay. If you decide to change your stay in any way once it has commenced (e.g. change accommodation or the duration of your stay), we accept no liability for any loss, damage or additional expense and we cannot guarantee a refund of any costs already paid by you.
4. IF WE CANCEL YOUR BOOKING
In exceptional circumstances we may find it necessary to cancel your booking and if so, we shall make all reasonable efforts to offer a suitable alternative. If this is not possible, and subject always to the next clause, we will refund your deposit and any other sum you have paid to us which shall constitute full settlement.
5. IF WE ALTER YOUR BOOKING
If it is necessary to alter the confirmed itinerary before departure, we will use all reasonable efforts to notify you as soon as possible. If these alterations are unacceptable you may cancel that part of your booking that relates to the alteration and receive a full refund for that part of the booking, which shall constitute a full settlement.
6. FACILITIES & SERVICES
A Check-in report is provided on arrival for the purpose of the client inspecting the condition of the Property at the beginning of stay. Any deficiencies noticed should be recorded on this report and the same returned to LondonUP! in the envelope provided. Failure to return this report is treated as acceptance by the client that there are no faults or deficiencies in the Property at the start of stay. Please note: No items must be removed from the Property during your stay. We cannot guarantee, or be held responsible for any failure or interruption of services to the Property or the building, including electricity, air conditioning, water or any damage. Broadband internet is provided by an external supplier and LondonUP! Ltd cannot accept any liability for loss of data or any other disruption to the service. This connection is not intended for home business use and LondonUP! Ltd accepts no liability for loss of business or earnings should the connection be interrupted. Disruption to telephone, television, broadband internet and other services, or noise caused as a result of repair works being carried out in another part of the Property are outside of LondonUP! Ltd's responsibility. However, upon notification by you, we will use our reasonable endeavours to maintain and rectify (within a reasonable period of time) all services to our properties. The weekly rental includes a weekly cleaning service for communal areas (in the case of Shared Houses and Flats) and Studios and One/Two Bedroom Flats.
7. NUMBER OF OCCUPANTS
The maximum number of people as agreed on your booking confirmation can stay at any one time. Only those persons listed on the Licence to Occupy and who have submitted Licensee Details Forms may occupy the Property on a full time basis for the duration of the booking. The Property cannot be re-let/sublet to any other group or party. The maximum number of occupants is indicated in the Room or Property information on LondonUP! Ltd website, and is recorded on your Licence to Occupy. Additional guests may from time to time occupy the Property with the prior consent of LondonUP! Ltd, a nightly fee of £15.00 per additional guest applies. LondonUP! Ltd reserves the right to refuse admittance to the Property to the client and their party if they are in breach of this condition.
8. CHECK-IN AND CHECK-OUT
Check-in is from 2.00pm and check-out is by 08.00am, alternative arrangements by prior written confirmation only. Keys are collected from a member of staff at the LondonUP! office. On departing, keys are to be left as agreed by client and LondonUP! Ltd when confirming departure arrangements. If there is a delay to departure, LondonUP! Ltd reserve the right to charge for one extra night's stay. If the keys are not returned or located as agreed, the key deposit £35.00 paid at check-in will be retained.
9. DEPOSIT, DAMAGE TO PROPERTY & PAYMENT OF ADDITIONAL CHARGES
The client who is responsible for booking undertakes that no person will suffer anything to be done anything which would endanger the policy of our insurers in respect of the Property and its contents which might make the same void or avoidable.
A good faith deposit is payable prior to arrival which will be held by LondonUP! for the duration of the stay and cannot be used to pay any amount of rent owing to the agency at any time. This good faith deposit will be refunded on the Friday following departure less any necessary and reasonable deductions made to cover the cost of such repairs and remedies needed to re-let the property in its original state and as a smoke-free environment. Such deductions are detailed on the Check-in Report given on arrival. Please note that we endeavour to make refunds on the first Friday following departure, providing the client has furnished LondonUP! with the requested card details. Whilst every effort is made to process refunds promptly, please note that delays can arise should there be a dispute regarding the sum due for refunding, and that once the refund is issued by our office, any further delays (owing to bank or card company clearance) are entirely outside the control of LondonUP! Ltd. In these cases you should contact your card or account provider.
Additional charges are applicable where your weekly rent is paid late, the fee fort the first day is £10.00 and for each subsequent day it is £5.00. Should you fall into arrears and fail to bring your account to balance with LondonUP! your details will be passed to our affiliated debt collection agency Daniels Silverman who will work to recover the sums owing from you. This will incur additional costs.
The client is responsible for taking all reasonable care of the property and its contents. The property and all equipment, utensils, furniture etc. must be left clean and tidy at the end of the hire period. Except in the case of normal wear and tear the client will be responsible for making good any damage to the Property or its contents which has occurred due to negligence, wilful damage or irresponsible behaviour on the part of those occupying the Property or their guests. Such damage must be reported, without delay, to our office. The cost of the repair or replacement must be agreed with and paid to LondonUP Ltd. Should a Property require a deep clean due to misuse or smoking then additional charges will be incurred by the Licensee. In the event of any breakages or damage discovered after you vacate, we will notify you by e-mail within 1 week of your departure, providing a detailed breakdown of the damage and the cost of rectification. Where Possible, photographic evidence will also be supplied.
Lost Keys: If between the hours of 10:00 and 19:00 Monday-Friday (and 10:00 and 17:00 Saturday/Sunday) you lock yourself out of the Property and require assistance to re-enter the property, we reserve the right to impose a £30.00 call-out charge in addition to any charge for lost keys. If you are locked out outside of these office hours, you must contact a locksmith at your own expense to gain re-entry to the Property. Please note that if keys are lost, locks will be replaced and full sets of new keys cut and issued, the client will bear responsibility for these costs. If keys are not returned on departure a £50.00 portion of the good faith deposit for each set will be withheld.
Emergency Calls: If there is a genuine emergency regarding the Property outside of office hours, the client may contact LondonUP! Ltd by text message to the emergency contact number supplied on their contract. The client will receive a response detailing what action is to be taken either by the agency or the client, depending on the nature of the emergency.
10. LIABILITY
We are not responsible for the theft and/or damage of your personal belongings during your stay in any Property booked. Therefore you are advised to ensure you have appropriate Insurances in place. All warranties, conditions and other terms implied by statute or common law or otherwise are, to the fullest extent permitted by law, excluded from any contract with us and these conditions shall apply in their place. We regret that we cannot accept liability for any loss, damage or additional expense where the booking needs to be altered or cancelled or we are unable to perform our contractual obligations as a result of events of 'casus fortuitous'. In these Booking Conditions 'casus fortuitous' means any event which could not have been reasonably foreseen, or the consequences could not have been reasonably avoided, by us or the suppliers of the relevant services in question, even with the exercise of all due care. Such events may include war or threat of war, civil strife, terrorist activity, Industrial dispute, natural or man-made disaster, fire, adverse weather conditions and all similar events outside our or the relevant suppliers' control.
If you are booking for, as or on behalf of a business or business employee, that business shall indemnify us against all liabilities, costs, expenses, damages and losses (including any direct or indirect consequential losses, loss of profit, loss of reputation and all interest, penalties and legal and other reasonable professional costs and expenses) suffered or incurred by us arising out of or in connection with you, or your businesses, breach or negligent performance or non-performance of these terms and conditions.
If you are booking for, as or on behalf of a business or business employee, our total liability in contract, tort (Including negligence or breach of statutory duty), misrepresentation, restitution or otherwise arising in connection with the performance or contemplated performance of your booking shall be limited to the fees paid to us under your booking. We shall not be liable for any failure or delay in performance of our obligations which results directly or indirectly from any cause or circumstance which is beyond our reasonable control, including (but not Exclusively) act of God, outbreak of hostilities, riot, civil disturbance, acts of terrorism, revolution, the act of any government or authority (including but not limited to refusal or revocation of any licence or consent), fire, flood, lightning, explosion, fog or bad weather, interruption or failure of a utility service (including but not limited to electricity, gas, water or telecommunications), renovations undertaken at the property, strikes, lockouts or boycotts, embargo, blockade.
11. LAW & JURISDICTION
These conditions and terms of contract and all matters arising there from are subject to the Law of England and Wales and in the event of dispute, the client will be subject to the exclusive jurisdiction of the courts of England and Wales.
12. TERMINATION BY LONDONUP! LTD
LondonUP! Ltd has the right to terminate a booking at any time on the grounds of abuse to staff or other guests, mistreatment of the Property or criminal activity on the part of those occupying the Property or their guests. In such circumstances, LondonUP! Ltd is not obliged to provide or locate alternative accommodation. The period of notice and the proportion of refund are at the discretion of LondonUP! Ltd.
13. INJURY OR LOSS
LondonUP! Ltd cannot be held responsible for any personal injury, loss or damage to personal effects howsoever arising at the accommodation. Neither we, nor our representatives, can be held responsible for any circumstances beyond our control including, but not limited to, mechanical breakdown, illness or failure of any public service supply.
14. RIGHTS OF ACCESS
Representatives of LondonUP! Ltd or their subcontractors have the right of access to the Property at any time, with due regard to the convenience of the client, for the purpose of inspection of the property and to carry out any essential repair or maintenance work.
15. PETS
Regrettably no pets of any kind are permitted under any circumstances. The client is liable for any infringement of this rule.
16. SMOKING
Smoking is not permitted in the Properties or in the internal communal areas of any LondonUP! Property. Smoking is permitted on external balconies and in gardens (where present) only. Smokers must make use of the ashtrays provided and dispose of all waste safely and appropriately. Evidence of smoking in any part of the Property will render the client liable for the cost of remedies or repairs necessary to re-rent the Property as a smoke-free environment including repainting and specialist cleaning. Smoking in shared Rooms will render all Licensees liable to share the costs of repair works. Smoking in the Property will also result in termination of your Licence to Occupy with two (2) weeks' notice.
17. COMPLAINTS
We do not expect and certainly do not want dissatisfied clients, but in the event that you are not entirely satisfied with the service offered, you should direct all complaints to our office as soon as possible to by email to hcrm@londonup.com . We take all complaints seriously and take reasonable steps to settle any problem promptly and fairly. LondonUP! Ltd shall not have any liability for any complaint submitted after the completion of the rental period.
18. INFORMATION
All information supplied by LondonUP! Ltd, is given in good faith and is based on information available at the time. All reasonable measures have been taken to ensure the accuracy of any statement made either in writing or otherwise, but LondonUP! Ltd is not liable for any variation however caused. The client recognises that availability and general information can change at short notice in the accommodation market.
19. SECURITY OF TENURE
As LondonUP! Properties are used as serviced short-term accommodation they are exempt from security of tenure under the Housing Act 1988. LondonUP! Ltd reserves the right to access the Property at any time without prior notice if it deems necessary.
20. USAGE & NUISANCE BEHAVIOUR
The client will not engage in excessive partying, playing of loud music or general nuisance behaviour. Licensees must have regard for other occupants in the building. Loud music cannot be played after 10pm and before 11am. LondonUP! Ltd Management reserve the right to terminate your stay and contract if they deem such behaviour has occurred. In the event of such a breach the FULL security deposit will be retained by LondonUP! Ltd. No refund will be made if such behaviour is deemed to have occurred.
21. PROPERTY SPECIFICATION
Reasonable care has been taken that the content of our website (and/or other means of promotion or advertising) is correct but it is subject to amendment at any time without notice. All content on our website (and/or other means of promotion or advertising) is published in good faith. We do not warrant that the content of our website (and/or other means of promotion or advertising) accurately or completely describe any of the Properties. Our web site may link to other web sites, for the content, security and data policies of which LondonUP! carries no responsibility. You should note the following points about Properties:
* All Properties are individual and vary in style, size and layouts so furnishing details are not uniformly standard.
* Our website (and/or other means of promotion or advertising) may contain a plan of the layout of the Property. The plan will only be a general representation of the accommodation. Actual unit size, design, fixtures, furnishings and facilities may vary from those shown on the plan;
* The number of people permitted to occupy each Property is limited and governed by Licence legislation. In some Properties extra beds can be provided and this will be at a charge to be agreed at the time of booking. If the number of people permitted to occupy any Property is exceeded, we may refuse access to the accommodation and reserve the right to charge for additional occupants;
* You and your party must comply with any rules and regulations set by us. We recommend that you take time to familiarise yourself with the safety procedures in the Properties, the building and local area, paying particular attention to fire evacuation details and security.
* Under NO CIRCUMSTANCES should you interfere with ANY fire safety equipment installed in any LondonUP! Property. Please note that in some cases the removal of or tampering with fire safety equipment can carry legal sentences.
* LondonUP! Ltd is responsible for payment of all domestic bills including for internet connection and TV Licence, gas, electricity and water, and council tax, except in Studio Flats where the TV Licence is the responsibility of the Licensee. However if excessive use of any utility is made, occupants are responsible for payment of any additional charges made.
* Accommodation may not be able to operate heating and air-conditioning at any one time.
* Where internet or broadband connectivity is available, you agree to use such services in a responsible manner and not for any illegal purpose.
* We shall use reasonable endeavours to retain any items left in Properties for up to 3 weeks after the departure date. Please email contact.us@londonup.com for enquiries relating to any lost items. However, LondonUP! accepts no responsibility or liability for items lost or left behind on departure. It is the Licensee's responsibility to ensure they take with them all personal items at departure.

22. ACCEPTANCE OF TERMS AND CONDITIONS
All bookings are subject to these terms and conditions that are deemed to have been accepted in full by the client and all persons in the party. Payment of deposit and/or booking fee also indicates acceptance in full of these Terms and Conditions.
